ISLAMABAD: The Supreme Court has issued notices to political parties presenting no-confidence motion.
The Chief Justice of Pakistan today fixed for hearing of the petition of the Supreme Court Bar Association regarding the no-confidence motion and meeting and long march on D-Chowk. A two-judge bench comprising Chief Justice Umar Ata Bandial and Justice Muneeb Akhtar heard the petition.
The Chief Justice remarked that the petition of the petitioner is in political context, the court has to look at the constitution and not the political context of the country and the law should be implemented. The Supreme Court is concerned about the law and order. We have not taken notice of it but are listening to the petition. Yesterday we saw an incident which was against the right to freedom of expression and protest.
The Attorney General said that there is no other question about this, some government members were in Sindh House, which heated up the political atmosphere, suddenly the political temperature rose and this incident happened, the people have the right to protest peacefully but There is no justification for violence, there is no justification for breaking the law, I want to tell the background of the incident, 100 protesters were dispersed by the police from Sindh House, then 20 people came to protest, 13 people were attacked. Arrested and a case was registered in the police station secretariat, today the magistrate released 13 protesters.
The Supreme Court remarked that the no-confidence motion is related to politics, the court has nothing to do with it, we have nothing but attention before the Sindh House incident, the political process consists of many elements, Attorney General on the Sindh incident. The Supreme Court, while issuing notices to the political parties PTI, PML-N, PPP and Jamiat Ulema-e-Islami, said that the no-confidence motion should be in accordance with the constitution and law.
The Chief Justice said that if public property and national institutions receive threats, is raiding public property also a bailable offense, political process should be under constitution and law, members and institutions should get protection in accordance with the constitution, he hoped. All political parties will show restraint.
The Chief Justice said that the Supreme Court would not interfere in the political process but legal matters would be looked into. Sindh House has been damaged, all political parties should act in accordance with the law and not take any action against the law.
The Supreme Court sought a detailed report from IG Islamabad on the Sindh House incident and adjourned further hearing of the case till Monday.
Earlier, the spokesperson of the Supreme Court denied the report of taking suo motu notice of the attack on Sindh House and said that the Chief Justice did not take any suo moto notice of the attack on Sindh House. The President of the Supreme Court Bar has filed a petition and it will be heard.
It is to be noted that yesterday the Chief Justice Omar Ata Bandial had fixed the petition for hearing on Monday but then today it has suddenly fixed it for immediate hearing.
The Supreme Court Bar has said in a constitutional petition that the Speaker should direct the National Assembly to take action on the no-confidence motion in accordance with the constitution, and that government agencies should be prevented from arresting or detaining members of the National Assembly.
