ISLAMABAD: The Islamabad High Court (IHC) has issued notice to Prime Minister Imran Khan on the petition of Khawaja Asif and restrained the Sessions Judge from proceeding till the next hearing.
According to details, a hearing was held in the Islamabad High Court on the petition of Khawaja Asif against Prime Minister Imran Khan. The hearing was conducted by the Chief Justice of the Islamabad High Court Athar Minallah. The petition alleges that District and Sessions Judge and Prime Minister Imran Khan has been made a party in the petition. At that time, Khawaja Asif was in the custody of National Accountability Bureau in Lahore and was unable to give instructions to his lawyer.
The petitioner was arrested on December 29, 20 and remanded in custody till June 23, 2013, the lawyer said. The order is based on non-reading of the record. Khawaja Asif’s lawyer said that the session judge issued the illegal order without any legal authority and the illegal order was passed in violation of the procedure laid down in the CPC. ۔
The lawyer further said that Khawaja Asif is the parliamentary leader of PML-N who is a leading opposition party, while the defendant Imran Khan is currently the current chief executive of the country, Imran Khan holds the constitutional post of Prime Minister, only justice. It shouldn’t be, but it should be.
The lawyer requested the Islamabad High Court to declare the lower court’s order illegal, on which the Chief Justice inquired as to when the matter was pending with the Sessions Judge. The lawyer said that the matter has been pending since 2012. In his remarks, he said who is responsible for adjourning the case, on which lawyer Khawaja Asif said that the lawyers of both Khawaja Asif and Imran Khan are responsible, on December 17, 2021, the court should suspend the order of the session judge.
The court issued notice to PM Imran Khan and restrained the session judge from proceeding till the next hearing. The Islamabad High Court adjourned the hearing till January 12 on the petition of Khawaja Asif against PM Imran Khan. It may be recalled that Khawaja Asif had filed a petition in the High Court against the order of the Sessions Judge, in which it was requested that a unilateral action be taken against the non-compliance of Khawaja Asif’s lawyer. ۔
