Islamabad: In the Tosha Khana case, the Islamabad High Court canceled the warrant of Imran Khan and stopped police from arresting him.
The Chief Justice of Islamabad High Court, Amir Farooq, heard the application filed by Imran Khan for the arrest warrant of the ongoing Sessions Court in the Tosha Khana case. Imran Khan’s biometrics was done from Lahore, after which the hearing started.
Imran Khan’s lawyer Khawaja Haris, Barrister Gohar appeared before the court. PTI leader Shibli Faraz was also present in the court room.
The Chief Justice said that I was not expecting you to be here. Lawyer Khawaja Haris said that I had placed the decision of this court before the trial court, the trial court ignored the decision given by this court.
The court said that there are various objections including biometrics, on which Imran Khan’s lawyer Khawaja Haris said that we have done the biometrics from Lahore. On this, the court removed the objections to Imran Khan’s request and directed Imran Khan’s lawyers to provide the biometric receipt.
The court said that this court had asked the trial court regarding the undertaking and shortness to make an order with satisfaction, why the trial court did not approve the undertaking?
Khawaja Haris said that the trial court did not approve the undertaking keeping in view the Lahore incident, I had said that the action related to the Lahore incident was taking place there.
The court asked whether your undertaking still exists. On this, Khawaja Haris said that Imran Khan’s undertaking is still there.
Chief Justice Amir Farooq said that I have told about the security on the administrative side, I have also told the session judge about the security.
Khawaja Haris said that Imran Khan will appear before the court tomorrow, Imran Khan is only in danger that he may be attacked, the government also has information in this regard.
The Chief Justice of Islamabad High Court said that the session court will definitely consider the security of your appearance, undertaking means a statement before the court, if there is a violation, it will be contempt of court.
Imran Khan has given an undertaking in the court to appear in the Sessions Court yesterday, which was accepted by the High Court.
Later, Chief Justice Aamir Farooq stopped Imran Khan from arrest by stopping the implementation of the arrest warrant order of the Sessions Court in the Tosha Khana military action case.
The Islamabad High Court said that Imran Khan should appear within the court time tomorrow, if Imran Khan does not appear, contempt of court proceedings will be taken.
