In its decision, the Election Commission disqualified Imran Khan for the crime of concealing assets in the Tosha Khana reference and ordered criminal action against him. After the decision, Imran Khan ceased to be a Member of the Assembly and the Election Commission also declared his National Assembly seat vacant.
The Election Commission declared that Imran Khan was involved in corrupt practices, he is being disqualified under Article 63 OneP for submitting a false statement, and criminal action should be initiated against him.
The Election Commission declared Imran Khan guilty of misdeclaration and said that Imran Khan deliberately submitted false returns to the Election Commission and did not disclose the gifts received in the returns. The amount was not disclosed.
The judgment said that the bank records submitted by Imran Khan were inconsistent with the value of the gifts, the stand he took in his reply was vague, he also concealed facts in the returns for the financial year 2020-21, which resulted in They violated Sections 137, 167 and 173 of the Election Act.
According to the Tosha Khana reference document against Imran Khan, Imran Khan received gifts worth 142 million 42 thousand rupees from Tosha Khana, while gifts worth more than 30 thousand rupees were received by paying.

Background of Tosha Khana Reference Case

The reference filed under Article 63 of the Constitution sought the disqualification of Imran Khan under Article 62 1F. Later, Imran Khan submitted his written response to the Election Commission on September 7 in connection with the Tosha Khana reference, according to which 58 gifts were given to the Prime Minister and his wife between August 1, 2018 and December 31, 2021.
