In front of a 2-member bench headed by Justice Muhammad Iqbal Kalhoro, the petitions related to the extradition of the girl from the parents and husband on the issue of going from Karachi to Lahore to get married were heard, in which the girl’s husband Zaheer Ahmed also appeared before the court. happened
During the hearing, the lawyer of the accused Zaheer Ahmed took the position that the request of the girl’s father is not admissible. The same application is currently pending before the trial court. How can a girl be detained? The girl was transferred to a shelter home by the court, how will the detention be imagined? The girl is the main witness, how can the parents be handed over?
The court asked the girl, “Where do you want to go?” The girl gave a statement and said that she wants to go with her parents. The court asked that you have no reservations. The court said that the girl wants to go with her parents, what can the court do?
The court remarked that the girl wants to go to you, you should give bail. Zaheer’s lawyer requested the court to stop the girl from going abroad. Justice Muhammad Iqbal Kalhoro said that you are right that marriage still exists. In interior Sindh, if a girl leaves, she is killed.
The court asked the father what bail he gave. The court told the father in a dialogue that you are giving the baby, you also have a lot of responsibility. The plaintiff’s lawyer told the court that if the girl is to be taken for pilgrimage, her permission should be required. On which the lawyer of the accused said that this is our concern that the girl can be transferred abroad.
The court ordered the father not to take Biji abroad and ordered the shelter home to hand over the girl to her parents.
The court remarked that the girl should be handed over to her parents after completing legal proceedings. At the same time, the court rejected Zaheer Ahmed’s request to hand over his wife. According to the decision, the court handed over the interim custody of the girl to the parents. The court declared that the decision of permanent custody will be decided by the trial court.
The court directed the father to submit a surety bond of Rs 10 lakh and remarked that every week the child protection officer would be bound to inquire about the welfare of the girl. A lady police inspector will also be present during the meeting with the girl. Later, the court disposed of the petition.
