In the Punjab Assembly, 25 deviant PTI members are seeking refuge in technical clauses. Their lawyers pleaded before a bench of the Election Commission that the spirit behind Article 63A of the Constitution should not be defeated.
According to the report, most of the deviant members of the provincial assembly had tried to defend the PML-N’s move to vote for Hamza Shahbaz Sharif, claiming that they had not received any instructions from the party.
He had raised objections to the procedure, claiming that he had never received show cause notices which is a necessary requirement for a member to be declared a defector. Barrister Ali Zafar, representing the PTI before a three-member bench of the Election Commission He argued that one of the purposes of Article 63A was to eliminate deviation from politics.
Senator Ali Zafar argued that if the deviators were not de-seated, it would be tantamount to encouraging deviations. Faisal Farid, a lawyer for the movement, said that Showcause notices were issued for participating in the by-elections. He told the commission that he did not refuse to vote for the opposition candidate and deliberately damaged his party’s position. Postponed.
Deviant members of PTI in their answers questioned the veracity of the declaration of deviation and the procedure adopted for their disqualification. Which is invalid in the eyes of the law. Another member of the Provincial Assembly, Malik Asad Ali, has claimed that he is not guilty of deviation, citing the alleged violation of the same article which has led to his disqualification case.
