ISLAMABAD: The Supreme Court has said in the decision of the case related to the recruitment of LESCO Company that highly educated, less qualified person is not entitled to the post.
While passing judgment on the case of an engineer who was recruited as line superintendent in LESCO company, the court said that a person with more education is not more entitled to a post with less education. Justice Mansoor Ali Shah filed a case on recruitment criteria in autonomous government institutions. The decision said that the appointment of an engineer on the post of line superintendent will affect the organizational hierarchy of the organization and disrupt the work.
The court declared that which person should be recruited by the institution and who should not be recruited? The court cannot decide. It is not a discriminatory or arbitrary decision of the institution not to appoint a more qualified person. Anyone who does not meet the company policy, no matter how highly qualified, cannot be recruited. It is not the function of the court to examine the eligibility of a candidate.
Appointing more qualified people to less qualified posts also has social implications, the judgment said. People with less education will be deprived of employment opportunities while people with higher qualifications will be encouraged.
It should be noted that LESCO refused to recruit engineer Waqas Aslam, who was recruited as a line superintendent in 2015, however, upon approaching the Lahore High Court, the court ordered the engineer to be recruited as a line superintendent, which LESCO challenged in the Supreme Court. was
It was stated by LESCO that Line Superintendent Waqas Aslam, who has been working since 2015, is no longer opposed due to service. This time they recruit Waqas Islam by giving a discount, but such a discount should not be given in the future.
The Supreme Court ruled that in future, a person with higher qualifications will not be entitled to a post with lower qualifications.
